Mobile Terms of Service

These Mobile Terms of Service ("Mobile Terms") apply to the Biotivia text message program (the "Program") operated by BIN Science LLC d/b/a Biotivia Health ("Biotivia," "we," "us," or "our"). By opting in to the Program, you agree to these Mobile Terms, our Terms of Service, and our Privacy Policy, which are incorporated by reference.

1. Program Description

When you opt in, you may receive recurring automated marketing and informational text messages (SMS/MMS) from Biotivia, including product news, promotions and discount codes, subscription and order reminders, cart reminders, and account or order updates. Message frequency varies.

2. How to Opt In

You can opt in by entering your mobile number and checking the consent box or submitting a sign-up form on our website, at checkout, or through a pop-up, or by texting a keyword to our number. By opting in, you confirm that you are at least 18 years old, that you are the account holder or authorized user of the mobile number provided, and that you consent to receive recurring automated marketing text messages from Biotivia at that number, including messages sent using an automatic telephone dialing system. Consent is not a condition of any purchase.

3. Message and Data Rates

Message and data rates may apply. Charges are billed by and payable to your mobile carrier. Please check your mobile plan for details.

4. How to Opt Out

You can cancel at any time by replying STOP to any message. You may also reply CANCEL, END, QUIT, UNSUBSCRIBE, or STOPALL. After you opt out, you will receive one final message confirming that you have been unsubscribed, and you will receive no further marketing messages unless you opt in again. If you subscribe to multiple Biotivia programs, you may need to opt out of each separately.

6. Supported Carriers

The Program is available on major U.S. carriers. Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your carrier and is not guaranteed.

7. Changing Your Number

If you change or deactivate your mobile number, you agree to reply STOP from the original number before doing so, or to notify us at the contact information above, so that messages are not sent to the new owner of that number.

8. Privacy

We respect your privacy. Information collected through the Program is used as described in our Privacy Policy. We do not sell, rent, or share your mobile number or text messaging opt-in consent with third parties or affiliates for their own marketing purposes. We may share information with service providers (such as our text messaging platform) solely to operate the Program on our behalf.

9. Eligibility

The Program is intended for residents of the United States who are 18 years of age or older.

10. Promotions

Offers and discount codes sent by text are subject to their stated terms, may be limited in time or quantity, and cannot be combined with other offers unless stated otherwise. Biotivia may modify or end any promotion at any time.

11. Disclaimer and Limitation of Liability

The Program is provided "as is" and "as available." To the fullest extent permitted by law, Biotivia is not liable for any delays, failures in delivery, or errors in messages, or for any damages arising from your participation in the Program, except as set out in our Terms of Service. Content sent through the Program is for general information only and is not medical advice. Our products are not intended to diagnose, treat, cure, or prevent any disease.

12. Changes to the Program or These Terms

We may modify or discontinue the Program, or update these Mobile Terms, at any time. Changes are effective when posted on this page. Your continued participation after changes are posted means you accept the updated terms.

13. Governing Law

These Mobile Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law principles.
